VOIP – Terms of Service Agreement

  1. VOIP Services:

a. These terms and conditions apply to the Voice over Internet Protocol (VOIP) services provided by Triple B Worldwide, Inc.. Although the services will provide reliable communication under normal circumstances, we cannot guarantee the overall reliability of our VOIP services. By using our VOIP services or setting up an account, you agree to be bound by these terms, our Agreement, our Privacy Policy, and to use our VOIP services in compliance with these terms and other policies.

  1. 911/E911 Disclosure:

a. Triple B Worldwide, Inc.’s VOIP services, including 911/E911 services, will not work if your VOIP-enabled device (e.g. adapter or sip phone) fails, is not configured properly, or due to other reasons such as power outages, broadband service outages, network congestion, suspension or disconnection of your VOIP service due to non-payment or late payment, or if you fail to meet the minimum technical requirements. In case of a power outage, you may need to reset or reconfigure your equipment to use your VOIP service, including for 911/E911 purposes. It is recommended to have an alternative method for accessing 911/E911 services.

b. VoIP 911/E911 service is different from traditional 911 services. Enhanced 911 (E911) service is only available if you provide your physical address, name, and phone number to the Public Service Answering Point (PSAP) in your county of residence.

c. This information is obtained from a database that may take up to 7 days to update once the new information is provided. If you move or change your VOIP-enabled device to a different address, updating the 911/E911 database is your responsibility.

d. If you move or relocate your VOIP service to a new address, it is your responsibility to notify us of the new address. Please ensure that the physical address in your online account is the correct location where your VOIP-enabled device will be primarily used.

e. E911 GPS Option: We use a built-in navigator that provides us with your latitude and longitude, which we then use to obtain your physical location through a Geocoding API via Google Maps.

f. If you do not provide the correct physical address and need to use emergency services, your 911/E911 calls will appear with your old address information, which may result in emergency crews being dispatched to the incorrect location. We specifically disclaim any and all liability for incorrect or incomplete information provided by you to Triple B Worldwide, Inc. or any of its affiliates regarding 911 emergency services.

g. VOIP adapters require power to work. In case of a commercial power outage, your phone service will not work without a local power source.

h. Monthly statements may include 911/E911 surcharges of up to $85.00 per 911/E911 call placed.

  1. Service Distinctions:

a. Our VOIP service is not considered a telecommunications service and is subject to different regulations.

b. Uncontrollable events such as power outages, internet fluctuations, and upstream backbone provider issues may affect your service.

c. Our service does not support operator-assisted or 0+ calling, including collect calls, third-party billing calls, 900 calls, or calling card calls. Our service may not support x11 services in all calling areas (211, 411, etc.).

d. By signing up for our VOIP services, you acknowledge that the service may not be compatible with all non-voice communication equipment, including but not limited to home security systems, satellite TV systems, fax machines, medical equipment, etc.

e. By signing up for our VOIP services, you waive all claims against interference or disruption of these services and equipment.

  1. Prohibited Uses:

You may not use our VOIP services in a manner that we determine:

a. Threatens network security or capacity, degrades network performance, employs malicious software or malware, or otherwise harms network service levels;

b. Employs applications intended for unattended use, robo-calls, automatic data feeds, automated machine-to-machine connections, or applications that negatively impact network capacity or functionality;

c. Abuses our VOIP service, including robo-calls, spamming, or sending abusive, unsolicited, or other automated communications;

d. Resells our VOIP service, alone or as part of any other product or service;

e. Tampering with, reprogramming, altering, or modifying our software or devices to bypass our policies or infringe our intellectual property rights;

f. Causes harm or affects us, the network, other customers, employees, business, or any other person negatively; or

g. Does not comply with these Terms.

In the event of a violation of this section or any other of our Terms, we reserve the right to immediately suspend or terminate your VOIP services.

  1. Software Ownership:

We retain all ownership and intellectual property rights to all VOIP software used for our VOIP services.

  1. Service Scope:

All VOIP services and related software, intellectual property, systems, and processes remain our property unless otherwise stated. You may not sell, transfer, lease, encumber, or assign any software, intellectual property, systems, or processes to a third party.

  1. Additional Terms:

VOIP services are subject to all other Terms And Conditions posted by Triple B Worldwide, Inc. unless otherwise stated in this section.
